Terms of sale
TAKESIT sells visibility inside a stadium that exists on a screen. These are the conditions, in the order the questions come up.
01What you are buying
The right to have a named surface carry your colour, and your mark once we have one, for a stated number of matches. Seats in the stands, boards along the pitch, panels in the tunnel, ground outside: each is sold as a surface for a term.
You are not buying the seats. There is nothing to own, nothing to resell and nothing that grows in value; when the term ends the surface goes back on sale.
02How a term is counted
In matches, not in weeks. One match, 6 matches or 20 matches, and a match is one weekly event with a crowd in it, played as three rounds with a vote at the end of each.
A week without a match does not consume your term. If a fixture is called off, postponed, or ends without a vote, it does not count and your surface carries forward. You bought appearances, so appearances are what we count.
A surface goes live once the payment is confirmed. For now it is set up by hand: within two working days of the payment we put it in the stadium and write to you, and the first match it appears in is the first one counted. A bank debit that has not cleared yet does not start anything.
03Price, and what is added
Prices are shown per seat and per match before you commit, and the total is shown before payment. A business pays twice what a private person pays for the same surface: the surface is worth more to somebody selling something on it.
Prices on the site are net of VAT. Before you pay, the checkout shows the net amount, the VAT and the total, and the total is what you are charged. A private person, and a business based in Italy, pay Italian VAT at 22%. A business in another EU country with a valid VAT number pays no Italian VAT, under the reverse charge, and a business outside the EU pays none either.
Payment is taken by Stripe Payments Europe, Limited, on its own page, by card or by the other methods it offers there. Your card details never reach TAKESIT. A business with a signed insertion contract pays in advance against the invoice, by bank transfer or through the Stripe link written on it.
A business always receives an electronic invoice through the Italian Sistema di Interscambio, and so does a private person who asks for one at the checkout. Stripe emails a receipt for every payment.
04Bidding for the pitch
The two brands in a match are decided on the open board, not by us. An offer is binding while it stands and is released the moment it is outbid, with nothing withheld.
The board closes at a moment nobody knows, including us: it is drawn by the system, between 3 and 5 days after the board opens, from the match number and a key, and there is no lever by which anybody can move it. The exact instant is published once it has passed. There is no last minute to wait for, so the price to offer is what the slot is worth to you on the day.
Winning the board buys you the match. It does not buy the result.
05The crowd is not for sale
Votes are free, need no account, and cannot be bought, sold, weighted or arranged. One browser counts once in each of the three rounds, and the match goes to whichever brand has the higher total of validated votes across them. Level totals get one further vote of 15 minutes, once; still level, and the match stands undecided rather than being settled by us.
Buying half the stadium does not move the count by one. If we ever find votes being manufactured, or the count of a round behaves in a way we cannot explain, the round or the match is void and we say publicly why. Where the manufacturing is a brand’s own doing, that brand is out with no refund of the offer that put it there.
Winning gives the plaque on the home page and the record, and nothing else. No free match, no discount, no priority in the next auction, no money. The brand that wins queues up and pays like everyone else for the next one, so a result is worth exactly what people think of it and not a euro more.
Between businesses this clause needs a specific approval, given with a one-time code at the order: manufactured votes void a match, and a brand that manufactures them is out without refund.
06Your mark
Covered separately by the brand mark terms, version 1.0, which you accept when you upload one.
07Changing your mind
If you are buying as a private person and not for a business, you have fourteen days to withdraw, without giving a reason. To do it, write to info@takesit.fun saying you withdraw. You can use the model withdrawal form in Annex I, part B of the Italian Consumer Code, but you do not have to. We confirm receipt, and refund within fourteen days by the means you paid with.
Asking for your surface to go live before those days are up is a request for immediate performance, and the checkout will ask you that separately and expressly: you can still withdraw, and you pay for the matches already shown.
A business purchase is not covered by that right, and does not pretend to be.
08What we can refuse
We can refuse or remove a surface, a mark or a brand for stated kinds of reason: content that is unlawful, a mark used without the rights clause 6 requires, a breach of these terms, or an order we have to obey. We tell you which one applies. Where we refuse or remove something you were entitled to show, you get back the unexpired part of what you paid; you lose it only where the removal follows your own breach, and we say so with the reason.

09If the stadium is down
A match your surface should have appeared in but did not is not counted against your term. Between businesses that is the whole remedy, except where the failure is due to our wilful misconduct or gross negligence, or the law does not allow the remedy to be limited; it is deliberately the same remedy as a cancelled fixture, because you are owed appearances and you get them. If you bought as a consumer, nothing in this clause takes away a right the law gives you regardless of what a contract says.
Between businesses this clause needs a specific approval, given with a one-time code at the order: the remedy for a missed match is limited, between businesses, to carrying the surface forward.
10Who can take part
Watching and voting are free, anonymous and open from fourteen. Nothing is collected from anyone who votes, so this is a rule of ours rather than one privacy law imposes: there is no data about a voter to protect, and no permission for us to ask.
Buying is different. A purchase is a contract, so you must be eighteen to buy anything here, or be a business. If we find that something was bought by somebody younger, we cancel it and refund what was paid rather than hold a child to a contract.
11Law
Italian law. If you bought as a private person, you can bring a case in the courts where you live.
